Defended Insurance Company in Suit Alleging Insurance Company Caused Death of Attorney

Issues/Disposition: The wife of a prominent San Antonio attorney was involved in a one car accident on a rainy day. She called her husband to come to the scene of the accident and help her. While contacting their automobile insurance company from the scene of the accident, the husband was struck by another car and killed after being thrown into the windshield of the car as his wife sat behind the wheel. Plaintiffs’ alleged that the accident would not have occurred if the defendant’s claims associate had not instructed the descendant to take pictures of the scene of the accident. The last demand prior to trial was in excess of $1,000,000.  This case was complicated by the fact that the decedent’s son subsequently committed suicide as a result of his father’s death and that two of the three main defense witnesses had been fired for unrelated reasons complicating their appearance at trial.  Plaintiffs also sued the defendants under the insurance code and deceptive trade practices act for subsequent issues associated with the handling of the original property damage claim. After trial began, the judge granted our previously filed motion for summary judgment dismissing the case.
