Issues/Disposition: 

Plaintiffs were represented by a high-profile plaintiff’s attorney practicing throughout the state. The alleged damages were over $5,000,000 and recoverable under the wrongful death and survivors’ statutes arising out of a fatality accident that occurred at a construction site.  A two-week trial ended in a hung jury.  The prominent plaintiff’s counsel attempted to reset the case for trial.  We then refiled our motion for summary judgment which was granted, and the case was dismissed.
