Defended Water Service in Lawsuit Related to Easement Issues

Issues/Disposition: Plaintiff alleged that the defendant, a water company, ran a two-inch underground waterline across a portion of her property without her authority. She claimed that she was unable to use her property for a mobile home park as intended because of the easement and that as a result she had damages in excess of $250,000.  The facts of the case clearly indicated that the defendant did not have a proper easement. After a multi-day trial, the jury found that although the defendant did not have the proper easement, the plaintiff’s physical damages and lost profits were zero.  The jury did award her $5,000 in nominal damages.
