Defended Trucking Company in Suit Related to a Driver Injuring a Pedestrian

Issues/Disposition:  Plaintiff alleged she was walking in a parking lot when a tractor-trailer owned and driven by Defendants allegedly collided with Plaintiff.  Plaintiff alleged the driver was negligent and that the owner of the tractor-trailer was negligent in hiring, supervising, training and retaining the driver.  A complicating factor in this case was that the driver could not be found and the company ceased to exist (Plaintiff obtained substituted service to initiate the lawsuit) and thus the case had to be defended without the insureds’ participation.  Plaintiff claimed damages in excess of $500,000. The jury awarded $6,200 in damages.
