Defended Client Against Multiple Causes of Action Alleging Damages of Nearly $100,000,000

We defended one of the largest insurance brokers in the country against another large insurance company who alleged it had paid millions of dollars in false claims because of our client’s employees’ creation of fraudulent policies. Plaintiff sought to recover more than $97,000,000 alleging multiple causes of action including violations of RICO, violations of federal trademark and state insurance laws, fraud, breach of fiduciary duty, negligence and breach of contract. Plaintiff incurred approximately $20,000,000 in attorney fees and expenses prosecuting the case. During the course of the litigation over 115 witnesses were deposed, including 35 expert witnesses, and millions of pages of documents were produced. Our client admitted that the policies were in fact fraudulent, so the goal was to limit damages. During the trial, the court dismissed the RICO claim and granted a directed verdict in favor of our client on all pending claims, awarding $2,000,000 against our client and $250,000 in exemplary damages.
